Albany Gastroenterology Consultants, a New York-based practice, has agreed to settle a class action lawsuit arising from a 2024 data breach that exposed the personal information of nearly 60,000 individuals.

Albany Gastroenterology Consultants has reached a settlement in a class action lawsuit stemming from a 2024 cyber security breach that compromised the personal data of over 55,000 people.
In 2025, Albany Gastro reported to the Maine Attorney General that it detected unauthorised access to its internal network on November 19, 2024, disrupting access to certain critical systems. An investigation with external cyber security experts determined that on November 10, 2024, an unknown threat actor accessed and acquired personal information of 57,751 individuals, including their names, personal identifiers, and Social Security numbers.
A class action lawsuit was subsequently filed against Albany Gastro in the Circuit Court of Miami-Dade County, Florida, alleging that the healthcare provider failed to maintain adequate safeguards to protect patients’ personal information. The suit further claims that Albany Gastro did not implement reasonable and appropriate cybersecurity measures, which contributed to the data breach.
While Albany Gastro denied any wrongdoing or negligence, both sides agreed to settle the case to avoid the costs and risks of continued litigation and allow Class members to receive benefits under the settlement.
As part of the settlement, all Settlement Class Members will receive an enrollment code for two years of CyEx Medical Shield Complete, which includes up to $1 million in medical identity theft insurance and monitoring for healthcare insurance IDs, Medical Record Numbers (MRNs), and unauthorised HSA activity.
The settlement also allows Class Members to claim up to $2,500 for documented out-of-pocket expenses resulting from the breach, including losses related to identity theft, credit monitoring, and ID replacement. Alternatively, Class Members may opt for a one-time cash payment expected to be $10 without providing documentation. Each benefit is subject to a $100,000 cap, with payments reduced proportionally if total claims exceed the applicable limit.
The proposed settlement has been granted preliminary approval by the court but has not yet become final. A final approval hearing is scheduled for September 22, when the court will decide whether to approve the settlement.
