Absolute Dental Group reaches $3.3m class action settlement over 2025 data breach

Absolute Dental Group has finalised a proposed class action settlement in Nevada over a data breach incident in 2025 that impacted over 1.2 million individuals.

 

As per the settlement agreement, the dental care chain will establish a settlement fund of $3.3 million to compensate affected patients whose data was accessed during the data breach incident. Individual members of the class action can avail a maximum of $5,000 as compensation provided they are able to provided documented evidences of financial losses suffered as a result of the incident.

 

Established in 2006, Absolute Dental runs more than 50 clinics in the US state of Nevada that are spread across the cities of Las Vegas, Carson City, Reno, Sparks, and Minden. 

 

The class action lawsuit, filed against Absolute Dental on April 9, stemmed from a data security incident that occurred between February 19, 2025, and March 5, 2025 and resulted in a third party gaining access to the company’s systems and exfiltrating vast amounts of patient data.

 

Absolute Dental told regulators that it completed its investigation into the incident on July 28, 2025, and determined that malicious actors had stolen patients’ personal and health information, including their names, dates of birth, contact information, Social Security numbers, state-issued ID numbers, health history, diagnosis and treatment information, health insurance information and details of benefits.

 

The dental care provider later notified the Office of the Attorney General of Oregon that the data security incident had compromised the data of approximately 1,223,635 individuals.

 

While agreeing to the terms of the settlement, Absolute Dental did not admit to any wrongdoing on its part but agreed to set up a $3.3 million fund for the benefit of affected patients and to avoid prolonged litigation. A third of the fund will cover attorneys’ fees while the rest will cover litigation costs and expenses and up to $2,500 as compensation to individual class representatives.

 

Individual class representatives have until June 18 this year to file their Claim Forms to avail compensation but if they want to exclude themselves from the settlement or raise an objection to the settlement terms, they must do so by June 9, 2026.
